Lawyer: Royal AM Have Not Accepted FIFA Decision

Royal AM lawyer Leruma Thobejane has provided an update on their stance after the club received a transfer ban by FIFA. 

Thwihli Thwahla have reportedly been slapped with a transfer ban by FIFA after they failed to compensate their former player Samir Nurkovic, who had not played an official match for them, for the termination of his contract.

Thobejane confirmed the KwaZulu-Natal side's transfer ban by FIFA but says they are challenging that decision through the Court of Arbitration for Sport (CAS). 

"No, we have not accepted the decision but we have since referred an appeal to CAS. We received communication this afternoon (Thursday) that CAS has indeed received our appeal documents," Thobejane said on Marawa Sports Worldwide


Thobejane continued and said they will exhaust all legal avenues and also revealed that they have filed an urgent appeal for CAS to set aside a transfer ban by FIFA, pending the outcome of their appeal. 

"Certainly, we have to exhaust all legal remedies that are available to us and after a decision is rendered by CAS, then depending on whether we're successful or we're not successful then we'll take it from there," he said.

"There is a principle and one rule in law that says decisions are respected until set aside. We're saying for now we'll request CAS for an urgent relief, which is to set aside the ban, pending the appeal. 

"We're saying in so far as procedure is concerned, we believe we have not faltered and we're entitled to a fair process. The case may be won, may be lost but there must be fairness of adjudication of that case."

Nurkovic is allegedly owed R12 million by Royal AM and their FIFA ban would be lifted if they pay that amount and Thobejane was also asked if they had budgeted to pay that figure in case they lose their appeal at CAS. 


"I can only talk about the merits of our case. The merits of our case is don't budget R12 million to pay him (Nurkovic)," he added.
