No Resolution For Roses

The situation at struggling National First Division side, Roses United, has turned out to be a fiasco of note with former owner, Samuel “Max” Tshabalala assembling a new side in Bloemfontein, but unable to register a single new player until he’s paid millions of rands owing in DRC claims.

Despite Tshabalala insisting that current chairman, Sinky Mnisi, must pay him the R8-million owing, Soccer Laduma has discovered from lawyer Michael Murphy that Tshabalala is in fact, the person in the wrong.

“Why should Mnisi pay one cent when “Max” is saying ‘I’m taking the club back?’ Murphy argues. He (Max) gave a whole set of warranties in the sale agreement to satisfy the PSL, claiming all the previous player issues had been resolved but this was not the case. We then had twenty-two player disputes get referred to the DRC worth I think R3.1-million. This was followed by five more, on the face of it about another R1-million, and a further three."

“Tshabalala goes around telling everybody he’s starting a new team, you can’t do that, you have to comply with the current contract. We (Roses) never took on the debt for those millions, so he must first pay otherwise nobody will consent to re-transfer.”

Murphy confirmed that Mnisi “wants to cancel the deal” but is afraid that if no payment is forthcoming, the very future of the club could be at stake.

“We’re going to end up here with an insolvency. If there’s anything of value, it should be the club and we hope the current players will continue playing. 'Max' is completely in the wrong. I keep asking him, ‘Have you paid the claims you admit?’

"He must pay so that the executive committee can consent to the transfer,” he concluded.

Today a meeting between Mnisi and SAFPU was scheduled to discuss the question of current players going back to Bloemfontein.
