Ajax Await Response From PSL As They Are Reinstated In Their League Position

Judge Rules In Ajax Cape Town's Favour To Set Aside Judgement

Ajax Cape Town have officially been reinstated into 15th position on the Absa Premiership, with the results of the promotion/relegation play-offs now officially invalid.

The Urban Warriors appeared in court today, where the judge issued her final verdict on the matter.

It has since been confirmed that Advocate Mokhari’s previous ruling to have Ajax docked points and relegated to the National First Division has been set aside by Judge Fischer, which means that the Urban Warriors are now reinstated to the 15th position, although the matter is not over yet.

The Premier Soccer League is expected to respond to the ruling, although this time the parties involved will have to appear before FIFA. 

Ajax have since responded on the matter.

“We have obviously just received the ruling now so, they have time to see what is the next step. It is not up to us, it is up to the league because they are the one who has actually lost their case. We have won our case in appealing the decision and asked for that decision of Adv Mokhari’s award to be set aside. 

"We officially should be off the list of being relegated and back in to number 15, so we are not the ones who are going to come up with the next step, if the league needs to, they could appeal the decision which we don’t know yet but as Ajax we will have to wait for the league to respond to the ruling,” the club’s communications manager, Shooz Mekuto told the Siya crew.

@Ms Momo ,,, Sure Khoza was aware, OPFC were also involved in the protest of Ajax having fielded Ndoro. Ajax were made aware of the rule by PSL before they started their defiant action of approaching the DRC which has no jurisdiction in this matter, and subsequently started fielding the player amid raised eye brows :)) Khoza or PSL is not to blame for the incompetence of the Ajax management. They went into this situation with their eyes wide open. They must go down shem :((

@setlaboswana ,,, Let's wait and see. All I know is that Ajax were made aware of the rule before they started fielding Ndoro. They decided to take the matter to the DRC in protest of the rule. A club can register a player like Ndoro but they cant play him according to the rules. This matter can still be appealed by PSL/SAFA. It's not over yet :)) Personally, I want Ajax to go down for their defiant stance :))

@Fifi.Siwelele plus Anfield the results are nullified after this ruling. All teams that were involved in the play offs might be gearing up to take the matter back to court, Ajax is back to #15. What does this mean to the promoted team (Leopards)? Had they waited there'd be less issues to deal with, I know the guys got families but postponing playoffs wasn't gonna block their salaries, it was only gonna keep them in the dark regarding their PSL/NFD status.

@TBS cum on dis issue does not nid anyone to clarify it's simple khoza must take full responsibility in fact he must resign period der is no excuse here Ajax aproched de psl & dey were given green light Ajax followed de protocol dis shows dat khoza was asleep al along only to wake on de pay day u cant b man of house & u claim not know wat has been happening in yr home thus incompetent

@TBS, on whether or not the Court was an appropriate forum to entertain the matter, I would say the High Court has what we call inherent jurisdiction, it can hear and decided on any matter unless prohibited by law. Judiciary is above any administrative body. But if indeed the Court erred, our law allows the Court 's decision to be appealed to Higher Courts.

@TBS, PSL and SAFA, our custodians of our football are confused just like us football supporters, they failed to give clear guidelines and direction on the matter, in fact, Ajax were given an impression that all is well and Ndoro 's registration is above board, thus legible to play, it was only when allegations of his illegibility were made that the PSL became reactive, you don't need this kind of incompetence at this level my friend. Like the father of the family or President of the Country would be held accountable for what happen in the family or County, Khoza should be held accountable for the Ndoro saga by virtue of him being the League 's chair.

@setlaboswana ,,, The judgement states in part that the arbitrator appointed by SAFA has no jurisdiction to give out the ruling on this matter. It further states that only FIFA can give that ruling, hence my earlier response that FIFA will send the matter back to SAFA should they be approached again :(( I think the High Court erred. If the PSL DRC could mislead Ajax, and the arbitrator appointed by SAFA can't make a ruling to rectify that, then the court itself has no jurisdiction in this matter. It should have referred Ajax directly to FIFA. It's a merry-go-round :))

@setlaboswana ,,,What has Khoza got to do with this? FIFA directed SAFA to address the issue 'cause they are the mother body in SA. They instead appointed an arbitrator... and the rest is history. I still maintain that Ajax should have approached FIFA for clarity in terms of the rule before fielding Ndoro, but they chose to circumvent the rule by using an irrelevant structure to challenge it. They dug their own grave. They should go down.

@TBS, well, I have not read full Judgment, I am not sure if the Court issued directives to take the case back to SAFA or FIFA for that matter. I was under the impression that all internal remedies were exhausted before the case was heard in Court.

@setlaboswana ,,,I hear u my dear friend, but Ajax on the other hand should have known better than to challenge this rule through an outsourced PSL DRC. FIFA will not abide by the Court ruling, they will force SAFA to make a final ruling on this matter. My best bet is that Ajax will not return :))

Simple, just add the number of teams in the league with one team, and going on two last/bottom of the log OUT and Top Two from NFD straight to PSL

@TBS, the league 's blunder was to continue with play-offs while the matter was still pending. Not only this latest development an indictment on the league leadership, but also a huge embarrassment to our football.
