Wits Sale: The Facts About Chiefs’ FIFA Ban

While they await their September 9 hearing at the Court of Arbitration for Sport in the hope that their FIFA ban will be overturned, Kaizer Chiefs are missing out on the now famous jumbo sale at Bidvest Wits.

There seemed to be confusion on Monday whether Amakhosi, who were slapped with a two-window transfer restriction by the world governing body four months ago, could now sign players as reports claimed they were now keen on both Thulani Hlatshwayo and Deon Hotto – but as things stand, that is unlikely.

Bobby Motaung, the Chiefs football manager, was also quoted indicating as much, making it clear that the club is obviously hoping to have the ban overturned, but could not discuss any possibility of signing new players.

According to Article 58.4 of the Fifa statutes: "The appeal shall not have a suspensive effect. The appropriate Fifa body or, alternatively, CAS may order the appeal to have a suspensive effect."

The CAS hearing is only in September. 

Hlatshwayo and Hotto are on the wanted list of both Mamelodi Sundowns and Orlando Pirates, the Brazilians having already tabled R17-million for the duo as well as their young attacking teammate Haashim Domingo.

The Glamour Boys were banned by FIFA for their handling of the ‘Dax’ signing from Fosa Juniors FC, an amateur club from Madagascar almost two years ago.

‘Dax’ has since joined Black Leopards and was also told he could not play football for four months, but has now subsequently served his ban and his employers expect him back in action, should the domestic league resume in the coming weeks.

What Chiefs are trying to find out from CAS is whether they can sign players while appealing the ban, but they can’t lift a finger until then.

Signing players with the belief that they will win the case only puts them at risk of a breach of contract should they fail to meet those obligations if the ban is upheld.

Until such a time, they are safer watching the Wits clear-out continue without their involvement until they know for certain that they have the greenlight from CAS.
