Dutch Court Gives Landmark Ruling In FIFA 22 Gambling Controversy

A Dutch court has made a ruling on the controversial FIFA Ultimate Team packs and as to whether or not it amounts to gambling.

Ultimate Team packs have been surrounded by controversy, and court cases, for some time now, with many feeling that purchasing the packs is a form of gambling.

This is because you are not certain of the players that will be in each pack, and could end up spending more and more in the hope of getting the player card that you want.

However, in a landmark case in Holland, the court determined that Ultimate Team packs were not considered gambling.

GiveMeSport, quoting GamesIndustry, revealed that the Administrative Jurisdiction Division of the Dutch State Council ruled that FIFA packs were essentially not a game of chance.

One of the main reasons for their decision is that the packs in FIFA are considered an "inseparable part" of the game, and with the court being the highest administrative court in Holland, the decision is final.

The ruling was covered over nine pages, with the aim being to determine whether the FIFA Packs amounted to being a game of chance. Although not illegal in Holland, a permit from the Dutch Gambling Authority would be required.

The documentation outlined that a game of chance is considered by specific criteria, namely: A participant should have an opportunity to win prizes and the winner of the game is determined by chance.

The judge had to consider whether the 'loot boxes' could be considered a standalone game, which would then be assessed as a potential game of chance.

The report on GiveMeSport stated, "In terms of Ultimate Team, the judge has ruled that it is a game of skill, although a mixed one, because the games played within the mode are won by the best player.

"The judge also rules that the packs are considered part of this mode, rather than a standalone game, because the packs are acquired and opened within Ultimate Team."

Although a landmark ruling for FIFA, it is an interesting take on loot boxes overall, and could open the door to more cases where loot boxes are used for trading purposes.
